Account balances

Transaction Terms

You authorise us to act upon any instruction we receive which is transacted using your password and customer number. This applies whether or not the instructions were actually given by you. We may (but we will not be obliged to):

1. inquire about or attempt to verify the authenticity of any instructions; or
2. refuse to act on any instruction if in our opinion this is justified.

Nothing in these terms and conditions means that we have any commitment to enter into any transaction with you.
We do not guarantee that email instructions sent by you will be properly received by us. Written confirmation of transactions which are conducted will be provided in the first statement issued following a transaction occurring. A statement may not include transactions conducted in the 24 hours before the statement is issued.

You should review all statements carefully and immediately notify MLC of any errors or omissions. We will keep computer records of the on-line communications between you and us, including your instructions and our responses, and the time of these communications. Unless there is an obvious error, these records will be conclusive and you agree that the records may be used as evidence in the event of dispute. You also agree that we may record telephone conversations which may be used as evidence in the event of dispute.

Security Terms

Password and Customer Number
We will provide you with a password.

You are required to:

1. change the password during your first access to this site using the password; 
2. change the password periodically in the future, at intervals of not less than one month; 
3. ensure your password is recorded once only and kept separate from your customer number; 
4. and keep the password secure so that it is not disclosed to or accessed by any other person.

You agree to comply with the above procedures.

Unauthorised Use of Password and Customer Number

If you know, or ought reasonably know, that some other person knows or may know your password, you must inform MLC immediately.

You will be liable, and MLC will not be liable, for any unauthorised use of your password or customer number if the unauthorised transaction occurs before you notify MLC that your password or customer number may be known by an unauthorised person.

You will not be liable for an unauthorised transaction using your password and customer number which occurs after you notify us if:

1. you give MLC all assistance it requires in investigating the unauthorised transaction or transactions; and
2. you were in no way responsible for the password and/or customer number becoming known to an unauthorised user.

If your password or customer number becomes known by an unauthorised user as a result of your act or omission or your failure to comply with these terms and conditions you will be liable for all unauthorised use, whether it occurs before or after you notify us.

Security Procedures

You are required to:

• take all reasonable measures to prevent unauthorised access to this site; and
• provide us with such assistance as we may require in making such security checks as we may consider necessary.

You consent to MLC monitoring your use of this site.

You should:

• Close all browser windows if you have finished accessing the website or intend leaving your PC unattended for any length of time.
• Avoid using a shared or public computer.
